We assist victims of all types of auto accidents

There were more than 5,000 injury crashes and more than 210 fatal accidents involving trucks reported to the California Highway Patrol in 2010. Because of the size and weight of trucks, truck accidents are highly likely to result in catastrophic injuries to the victims, including drivers and passengers of other vehicles and the truck drivers themselves. At McCarthy & Kroes, our truck accident attorneys understand the devastating effects an accident may have on all aspects of your life. With 25 years of experience as one of California’s well-respected injury law firms, we provide highly skilled and professional representation to help all types of victims obtain the compensation they need, including drivers of smaller vehicles that are struck by trucks and truck drivers who are injured by others.

Who is liable for a truck accident in California?

In any type of auto accident, liability depends on who had a duty to others, who breached that duty and whether that breach caused injuries, fatalities or damages. For example, if trucker negligence, such as speeding or using drugs, causes an accident, the trucker may be liable for the resulting injuries to others. However, the trucker’s employer may also be liable if the truck driver was acting in the scope of their employment. The same goes for employers of delivery truck drivers, such as FedEx or UPS, construction vehicle drivers and other drivers who injure third parties in the scope of their employment. However, drivers who are renting trucks, such as U-Hauls, and who were not working at the time of an accident, would be liable for any injuries or damages they cause.

At McCarthy & Kroes, our auto accident attorneys serving Santa Maria, Santa Barbara, Ventura and San Luis Obispo represent victims of truck accidents involving all types of negligence and liability by different parties:
